The lawyer of the former Argentine president Cristina Fernández, Gregorio Dalbón, presented this Monday a criminal complaint against Javier Milei for “abuse of authority“, following some controversial statements made by the president in an interview broadcast by the La Nación + channel on Sunday night.
He ‘libertarian‘, as he defines himself, He boasted that he was the one who “made the decision” to “take prisoner” to the Peronist leader, which in the opinion of the former president’s defense would constitute a clear case of lawfare.
During the interview, Milei tried to justify that the complaints against José Luis Espert, his head of the list in the province of Buenos Aires in the legislative elections of October 26, who had to resign due to links to drug traffickingthey were a “revenge“of Kirchnerism for the conviction of Cristina Fernández.
“I can assure you that This is revenge for the fact that I am the first president who made the decision for me to go to prison. (Cristina Fernández),” Milei said to the surprise of her interviewer.
It was of no use that journalist Luis Majul unsuccessfully tried to get him out of the mess he had gotten himself into: “But you don’t get involved with Justice…”.

“That’s the problem, I don’t get involved with Justice. Let’s say, that is, I can assure you that if I had been dirty and had gotten involved with Justice (…) I would not be suffering from this,” Milei responded, now implying that he could have done something so that the former president was not convicted.
Milei’s controversial statements have sparked controversy in Argentina by raising serious suspicions about judicial independencealso giving ammunition for the defense of Cristina Fernández and her speech that she is imprisoned for political reasons.
In his complaint, the former president’s lawyer accuses Milei of “committing the crime of abuse of authority foreseen and repressed by article 248 of the Penal Code.” For the lawyer, Milei “presupposes an act of illegal authority, while the power to order or arrange arrests corresponds exclusively to the judges.”
According to the complaint, Milei’s statement “is part of a violation of the constitutional duty to refrain from intervening in judicial proceedingsconstituting the typical core of the abuse of authority” contemplated in the Argentine Penal Code.
Dalbón requested that Milei be summoned for investigation and that a copy of the complaint be sent to the Chamber of Deputies, in order to evaluate the opening of a political trial.
“The mere public affirmation of having made a ‘decision’ to deprive a person of liberty constitutes an indication of functional interference and institutional pressure on the Judiciary,” adds the document, which qualifies the episode as “an act of institutional gravity.”
Last June, the Supreme Court of Argentina ratified Fernández’s sentence to six years in prison e perpetual disqualification for irregularities in the concession of road works, but Peronism considers that it is a victim of ‘lawfare’, that is, of the instrumentalization of Justice by its political adversaries to persecute and discredit it.
Since then, Fernández is under house arrest in Buenos Aires.
