It was left to the last minute: the verdicts of the Constitutional Court (TC) on the Nationality Law will be known this Monday. The period of 25 calendar days ended on Sunday, The decision is due this Monday, December 15th. As with the Foreigners Law, in August, a public reading of the rulings should be called, at a time not yet confirmed.
There are two requests regarding the law, sent by the Socialist Party (PS), after failing to reach an agreement with the PSD in Parliament. The legislation, which provides, among other things, for the loss of nationality in the case of serious crimes, was approved with the votes of Chega’s bench.
The relative requirement The loss of nationality was the responsibility of the vice-president of the TC, João Carlos Loureiro. The diploma that concentrates the most profound changes will be analyzed by judge Dora Neto.
Among the norms that will be analyzed are the new rules on the naturalization of stateless people, the clause that allows opposition to nationality based on behavior that reveals rejection of the national community, the lack of a transitional regime, among others. This is the second time that Ratton Palace judges have been called upon to analyze laws related to immigration. In August, during the holiday season, the collective had just 15 days to decide on the Foreigners Lawwhose rapporteur was in charge of judge Joana Maria Rebelo Fernandes Costa. The request was made by President Marcelo Rebelo de Souza and had as a result the lead of the law as it was written.
But the Government did not give up. He readjusted the points highlighted by the judges and once again managed to get the legislation approved. André Ventura’s party was the one who guaranteed the votes necessary for AD’s victory and the law has been in force since October 23rd.
If the scenario is the same, with the lead of legislation, Luís Montenegro’s executive must do the same. To do so, it counts on Chega’s votes. However, the topic should remain until 2026, as this is the last week of voting in the Assembly of the Republic before the end-of-year recess. Sessions resume on January 7th.
